Terms and Conditions for StorybookU

Welcome to StorybookU! These Terms and Conditions (“Terms”) govern your use of the StorybookU website and services (the “Service”), which are operated by Aila Education LLC, a limited liability company registered in Virginia, USA (“we,” “us,” or “our”).

Please read these Terms carefully.

1. Acceptance of Terms

By accessing our website, using our Service, or placing an order, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not use the Service.

2. Our Service

StorybookU provides personalized, AI-generated hardcover storybooks. The stories and illustrations are created using artificial intelligence (AI) based on the photographs and character information you provide.

3. Orders, Payment, and Refunds

  • Custom Nature of Products: All storybooks are custom-made to your specifications. For this reason, we cannot provide a digital preview before printing and shipping.
  • Cancellations: Orders are sent to our printing partners shortly after they are placed. Therefore, cancellation requests can only be accommodated if made within 2 hours of purchase.
  • Payment: All payments are processed securely through our third-party payment processor, Stripe. We do not collect or store your payment card details. By providing a payment method, you represent that you are authorized to use it.
  • Refunds: We are committed to your satisfaction. If your book arrives with a significant manufacturing defect or is damaged in transit, please contact us at sales@storybooku.com within 14 days of delivery with a photo of the issue. We will gladly arrange for a replacement or a full refund. For dissatisfaction based on the subjective nature of the AI-generated story or illustrations, refunds are issued on a case-by-case basis at our sole discretion.

4. User-Provided Content

To create your storybook, you will provide us with content, including at least one photograph and personal details such as a name, gender, eye color, and age (collectively, “User Content”).

Your Representations and Warranties

You represent and warrant that:

  1. You are the legal owner of the User Content (e.g., you took the photograph) or have obtained all necessary rights, licenses, and permissions to provide it to us for the purposes outlined in these Terms.
  2. Your User Content does not infringe on any third-party rights, including copyright, trademark, privacy, or publicity rights.
  3. Your User Content is not illegal, obscene, defamatory, threatening, pornographic, or otherwise inappropriate or offensive.

Our Right to Moderate

We reserve the right, but not the obligation, to moderate, reject, or remove any User Content that we believe violates these Terms.

License Granted to Us

  • For Product Creation: You grant Aila Education LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and create derivative works from your User Content solely for the purpose of creating and delivering your personalized storybook.
  • For Marketing (Opt-Out Available): You grant Aila Education LLC a perpetual, worldwide, non-exclusive, royalty-free license to use the final, AI-generated images and story excerpts for marketing and promotional purposes (e.g., on our website or social media). Your original photos will never be used for marketing. If you do not want the generated content used for marketing, you must notify us in writing at sales@storybooku.com. We will honor all such requests.

5. Children's Privacy and COPPA Compliance

Our Service is intended for purchase by adults. We are committed to complying with the Children’s Online Privacy Protection Act (COPPA).

  • Age Requirement: You must be at least 18 years old to place an order on StorybookU.
  • Verifiable Parental Consent: By placing an order, you represent and warrant that you are the parent or legal guardian of any child whose personal information (name, age, likeness) is included in the User Content. If you are not the parent or guardian (e.g., you are giving a gift), you warrant that you have obtained explicit, verifiable consent from the child's parent or legal guardian to provide their information to us.
  • Purpose Limitation: You consent to our collection and use of the child’s personal information for the sole purpose of creating, printing, and delivering the storybook. This information is shared with our third-party AI partner (OpenAI) for generation and is deleted from our active systems after use, as detailed in our Privacy Policy.
  • Right to Deletion: If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly.

6. Intellectual Property

Our Intellectual Property

All content, branding, designs, and technology on the StorybookU website, excluding User Content and the final product delivered to you, are the exclusive property of Aila Education LLC. You may not reproduce, distribute, or create derivative works from our materials without our express written permission.

Your License to the Final Product

We retain the copyright and all intellectual property rights to the AI-generated text and illustrations in your final storybook. Upon purchase, we grant you a perpetual, non-exclusive, non-transferable license to use the physical book for personal, non-commercial purposes.

7. Disclaimers and Limitation of Liability

AI-Generated Content Disclaimer

Our Service uses generative AI, an imperfect and evolving technology. While we strive for high-quality, coherent, and positive results, you acknowledge that AI may produce outcomes that are unexpected, contain inaccuracies, or could be perceived as offensive. By using the Service, you accept this risk.

No Warranty

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

Limitation of Liability

To the fullest extent permitted by law, Aila Education LLC, its officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to emotional distress, reputational harm, or financial loss, arising from your use of the Service, the content of any storybook, or shipping delays beyond our reasonable control. Our total liability to you for any and all claims shall not exceed the amount you paid for the product.

8. Third-Party Services

To provide our Service, we rely on third-party partners. Your use of our Service constitutes your acceptance of their roles in the process:

  • OpenAI: We send your User Content (photo and character data) to OpenAI's API to generate the illustrations and story.
  • Stripe: Processes all payments.
  • Google Analytics: We use this service to analyze website traffic and improve user experience.
  • Printing: We use a printing partner to print and ship your storybook.
  • TypeForm: We use this service to collect your order information.

9. Dispute Resolution: Binding Arbitration

To ensure a timely and cost-effective resolution, you and Aila Education LLC agree that any claim, dispute, or controversy arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You agree to waive your right to a jury trial and to participate in a class-action lawsuit. The arbitration will be conducted in the Commonwealth of Virginia, unless otherwise agreed upon.

10. General Provisions

  • Modifications: We reserve the right to modify these Terms at any time. We will post the revised Terms on our website and update the “Last Updated” date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Aila Education LLC and supersede all prior agreements or understandings.
